Question: What are the rights of seniors to break a lease under specific circumstances?


Answer: A person age 62 or older may break a lease on thirty days' notice to enter a nursing home, subsidized housing, assisted living, or the home of a relative, if a doctor certifies that the move is medically necessary. When writing to your landlord, you should refer to Real Property Section 227-A.

As per Real Property Section 227-A, a tenant who is 62 years of age or older is entitled to break a lease with thirty days' notice when moving into a suitable living arrangement, provided there is a doctor's certification confirming the medical necessity of this move. Enclosed, you will find this certification from my physician.


Please let me know how you would like to proceed with the return of my security deposit and any other necessary steps to finalize this process.
