Can my landlord just move in with me in the house with a month-to-month tenancy or a one-year lease in New York State?

Summary

In New York State, whether your landlord can move into your rental unit depends on your type of tenancy and lease terms. For a month-to-month tenancy, the landlord must give you at least 30 days' written notice to terminate the tenancy if they want to move in or reclaim the premises. For a one-year lease (fixed term), the landlord generally cannot force you to move out before the lease expires unless there is a specific lease termination clause or an agreement permitting such action. Owner-occupancy eviction rules apply mainly to rent-stabilized apartments and have specific criteria, but landlords typically cannot simply move in with you without proper legal notice and court process if necessary.

- Month-to-month tenancy: Your landlord may terminate the tenancy by giving at least one full month's written notice before the tenancy ends, for any reason including their intent to occupy the unit personally. After giving notice, you must vacate by the termination date or face possible eviction proceedings if you do not comply https://www.nyc.gov/assets/buildings/pdf/tenants_rights.pdf

One-year lease:

During the lease term, the landlord cannot require you to move out simply for them to move in, unless the lease includes a clause allowing early termination for owner occupancy or you agree otherwise. Upon lease expiration, they may choose not to renew the lease if they want to occupy the unit, provided they follow proper notice rules. In rent-stabilized apartments, owner occupancy eviction has additional protections for tenants such as seniors or disabled persons 2 https://ag.ny.gov/publications/residential-tenants-rights-guide

Legal protections:

New York law protects tenants from illegal evictions or landlord actions such as changing locks without court orders. Illegal attempts to remove tenants carry penalties and tenants can seek legal help https://www.lawny.org/node/393/new-protections-ny-state-renters

Good Cause Eviction:

Since April 2024, under the Good Cause Eviction law, landlords cannot end a market-rate tenancy without a justified reason, potentially restricting arbitrary owner occupancy evictions depending on the locale and lease specifics https://www.nyc.gov/site/hpd/services-and-information/tenants-rights-and-responsibilities.page
